GENERAL TERMS AND CONDITIONS
1. General
1.1. These General Terms and Conditions (hereinafter referred to as "Terms") apply to all offers, orders and agreements of BATCH_04 BV, with registered office at Diksmuidse Heerweg 243, 8200 SINT-ANDRIES, Belgium, with company number BE1017.269.088 (hereinafter referred to as "BATCH_04", "we", "us").
1.2. By placing an order via our website or entering into an agreement with us, you agree to these Terms and Conditions.
1.3. Deviations from these Conditions are only valid if agreed in writing. 1.4. BATCH_04 reserves the right to change these Conditions. The most recent version is always available on our website.
2. Offers and agreements
2.1. All offers from BATCH_04 are without obligation, unless expressly stated otherwise.
2.2. An agreement is concluded at the moment that an order is accepted by BATCH_04.
2.3. BATCH_04 reserves the right to refuse orders without giving reasons.
3. Prices and payment
3.1. The stated prices are in euros, including VAT and excluding shipping costs, unless otherwise stated.
3.2. Payment must be made in the manner indicated during the ordering process.
3.3. In the event of late payment, the customer is in default by operation of law and BATCH_04 is entitled to charge statutory interest.
4. Delivery
4.1. Delivery will take place at the address specified by the customer, in accordance with our Shipping Policy.
4.2. The delivery times stated are indicative and do not apply as fatal terms, as further described in our Shipping Policy.
4.3. BATCH_04 is not liable for damage resulting from exceeding delivery times, unless there is intent or gross negligence on the part of BATCH_04. Consult our Shipping Policy for more information.
5. Retention of title
5.1. All delivered goods remain the property of BATCH_04 until the customer has fulfilled all its obligations.
6. Right of withdrawal
6.1. The customer has the right to terminate the agreement within 14 days after receipt of the goods without giving reasons, unless this is excluded on the basis of article VI.53 of the Code of Economic Law. Consult us Returns Policy for more details.
6.2. The customer must return the goods in their original condition and packaging, as further described in our Return Policy.
6.3. The costs for return shipment are at the expense of the customer, unless otherwise stated in our Return Policy.
7. Intellectual property rights
7.1. All intellectual property rights relating to the products and the website of BATCH_04 are vested in BATCH_04.
7.2. The customer is not permitted to use the intellectual property rights without the written permission of BATCH_04.
8. Liability
8.1. BATCH_04 is not liable for indirect damage, consequential damage or damage as a result of force majeure.
8.2. BATCH_04's liability is limited to the amount of the order, unless there is intent or gross negligence.
9. Force Majeure
9.1. In the event of force majeure, BATCH_04 is entitled to suspend or terminate the performance of the agreement.
10. Applicable law and disputes
10.1. All agreements between BATCH_04 and the customer are subject to Belgian law.
10.2. Disputes between BATCH_04 and the customer will be submitted to the competent court in Bruges.
